Maxwell Health Raises $2M To Take On Zenefits With Concierge Service, Personal Health Incentives

Leading the round is Tribeca Venture Partners, with participation from Lerer Ventures, Vaizra Investments, BoxGroup, TiE Angels and a few other angel investors. This round brings the company’s total funding to $3.8 million. Launched in February, Maxwell Health is a no-cost, benefits management service for businesses for medical, dental, vision, life, disability, COBRA administration, HRA/HSA, FSA and 401(k). CEO and co-founder Veer Gidwaney says the new round of funding will go to adding new service features, increasing outreach and building distribution. The startup allows employees to see a greater selection of insurance plans and provides advice on which to choose. Employees with existing plans can use Maxwell Health’s platform to manage their benefits on the portal.?Its dashboard allows businesses to track hiring, employee engagement and company spending. Maxwell Health can provide all this for free, because it earns commission for each insurance plan chosen by its users. If Maxwell Health’s business model sounds familiar, that’s because it is? to a startup called Zenefits, which has seen large success in California and just raised $2.1 million.?Zenefits has about 110 clients and is in the top five percent of California’s insurance brokers, according to our recent coverage?of?the company. Its service provides management of payroll, hiring, medical, dental, vision and 401(k). But a couple of Maxwell Health’s features could give it an edge against Zenefits, as well as healthcare organizers like Cake Health and Simplee. Maxwell Health puts a heavy focus on independent health by offering incentives for employees to eat healthy diets and exercise regularly. Each employee uses a fitness device and receives points for activity, which can be traded in for rewards. Another notable addition is its “concierge service,” which acts as an advisor for health related questions and takes care of bills, insurance disputes and medical appointments. Users can send photos of their medical claims to the concierge and he or she will handle it on the user’s behalf. “When we walk into a company, our aim is to be the single point of reference of advice, of a trusted advisor on everything to do with benefits, health and well-being,” Gidwaney tells me. “We want to meet the company’s needs across the board.” With dozens of businesses on board, Maxwell Health a ways away from Zenefits client base. Global warming: The folly of certainty

Larry Jones is driving the minivan across the Utah desert on Highway 163, with Sally in the passenger seat and the two kids dozing in the back. According to the map they are approaching the town of Pawoopsie. The radio is on, tuned to a Pawoopsie station that plays country music, but the reception isn?t very good. Suddenly the music cuts off and an announcer?s voice comes in: ?static?one sixty-three?static?Pawoopsie?static?bridge collapsed?static?highway patrol says?static?, and then nothing but static.

Sally sits up. ?Did he say that the highway bridge in Pawoopsie collapsed??

Larry shrugs. ?I don?t know.?

?It sounded like that?s what he was saying.?

?I don?t know; too much static.?

?Aren?t we getting close to Pawoopsie??

?Yeah, should be a couple more miles.?

Larry, don?t you think you should slow down??

?Why??

?Well, if the bridge has collapsed . . .?

?Are you sure that the bridge has collapsed??

?No, but . . .?

?Then why should I slow down??

Here?s the thing about that story: it?s not at all hard to understand. You can tell it to 100 people, and 99 of them will realize that Larry Jones is being stupid. It doesn?t take a brilliant mind to figure out that when you?re hurtling toward possible catastrophe, only a fool would refuse to slow down and start paying attention.

Unfortunately, when it comes to the current debate about climate change, the scientific community has somehow worked itself into the position of implicitly assuming that the public are too stupid to understand that story. We have been treating the public as though they are a large mass of Larry Joneses. That?s a blunder, and one that has cost us big time.

The debate about climate change, as it is currently conducted, focuses mainly on this question: Are we certain that the Earth is going to warm to a dangerous degree in the near future? Climate scientists have been struggling very hard to convince us all that they are certain, or at least nearly certain, but haven?t succeeded all that well.

But that?s really not the right question at all. To think that is the right question is to behave like Larry Jones. The right question is: Are we confident that the Earth is *not* going to warm to a dangerous degree in the near future?

If we?re not confident of that, we?d be idiots not to at least slow down and start making serious plans.

I don?t believe that people are too stupid to understand that logic.

And the thing is, this is a much stronger basis for argument. Certainty is inherently hard to achieve when it comes to climate predictions. Climate depends on lots of variables in complicated ways, and many of them have not been measured with much precision. But if we stop talking about certainty and simply focus on the odds, then the situation clears greatly. There may be a few semi-plausible models that fail to predict serious warming, but the majority of models ? and the models that have the greatest acceptance in the community ? certainly do. Even if a skeptic prefers the models that don?t predict warming, can the skeptic really be *sure* that they are the correct ones?

If one isn?t sure, then to argue against any action at all is to behave like Larry Jones. A skeptic need not believe that we must immediately destroy the world?s economy by shutting down our use of fossil fuels ? it would be just as stupid for Larry Jones to jam down the brakes in the middle of the freeway as to do nothing ? but even a skeptic must see that prudence calls for slowing down, getting as much information as we can, and making contingency plans.

Twitter UK boosts anti-abuse tools after threats against women

LONDON (Reuters) - The British arm of Twitter apologized on Saturday to a group of high-profile women who have been threatened with death and rape on the micro-blogging site, and announced measures to make it easier for users to report abusive tweets.

Twitter had come under increasing pressure to react after a feminist campaigner, several women members of parliament and female journalists were targeted by users who hurled misogynistic abuse at them and in some cases made violent threats.

"I personally apologize to the women who have experienced abuse on Twitter and for what they have gone through," Tony Wang, general manager of Twitter UK, said on his own Twitter feed.

"The abuse they've received is simply not acceptable. It's not acceptable in the real world, and it's not acceptable on Twitter," he said.

Twitter UK said it was adding staff to help handle abuse reports. It also said an in-tweet "report abuse" button currently available on the Twitter app for iPhones would be added to the Twitter website and to platforms used on other mobile devices.

The problem of abuse by so-called internet "trolls" has been front-page news in Britain since activist Caroline Criado-Perez was hit by a barrage of vitriolic tweets after successfully campaigning for a woman's face to appear on bank notes.

In recognition of her role, Criado-Perez appeared alongside Bank of England Governor Mark Carney on July 24, when he announced 19th century novelist Jane Austen would become the face of the new 10-pound note.

Police arrested two men over rape threats against Criado-Perez. One of them was also suspected of making rape threats against opposition Labour legislator Stella Creasy, who backed the bank note campaign and also appeared with Carney on July 24.

In separate incidents days later, several high-profile female journalists received tweets from someone threatening to bomb their homes and "destroy everything" there.

London's Metropolitan Police Service said on Friday it was investigating allegations made by eight people who have been subjected to harassment, malicious communication or bomb threats.

While the trolls themselves have been denounced across British media, Twitter had also come under heavy criticism for its failure to respond forcefully enough.

In a statement issued after Wang's apology, Criado-Perez welcomed the new measures announced by Twitter UK but said a more profound overhaul of the social network's system for handling abuse was needed.

"The current process is lengthy, complicated and impossible to use if you're under sustained attack like I have been," she said.

"Right now, all the emphasis is on the victim, often under intense pressure, to report rather than for Twitter to track down the perpetrator and stop them."

Lollapalooza's broad appeal leads to biggest audience yet

CHICAGO (Reuters) - Lollapalooza, the three-day music festival in Chicago's historic Grant Park, was bigger than ever this year with a lineup that honored its alternative rock roots and broadened its appeal to fans of folk, dance, rap and even country music.

A record 300,000 people took in nearly 150 bands playing on eight stages set up across the mile-long park lawn just across the street from the shores of Lake Michigan.

The varieties of music were as disparate as the concert attendees. Teens in brightly-colored tank tops bobbed to the bass music of Dillon Francis in the dance arena on Friday while goths in black swayed to Sunday's closing set by alternative veterans the Cure.

Vampire Weekend supplied the literary pop, singing about the Oxford comma, while country-rocker Eric Church sang about drinking Jack Daniels and getting stoned.

The chart-topping pop folk group Mumford and Sons drew some of the largest crowds on Saturday who heard their banjo-and-acoustic guitar rave-ups "I Will Wait" and "The Cave," after another folk group on the rise, the Lumineers, warmed up the crowd from a stage across the park's lawn.

The sold-out annual summer event, which last year pumped $120 million into the local economy and booked many downtown hotels to capacity this year, is Chicago's largest concert.

Nine Inch Nails, the veteran alternative band fronted by Trent Reznor, played the first Lollapalooza in 1991 and closed Friday night with their first U.S. gig in four years.

A large portion of the crowd was not even born when Reznor burst onto the scene with his aggressive industrial rock, breaking through with the song "Head Like a Hole," which they performed toward the end of their set.

"I came here for the girls and (band) the Killers. I don't know who Nine Inch Nails are," said 15-year-old Ryan Coolidge, a resident of Chicago's northwest suburbs.

Two artists scheduled to perform Saturday night on the same stage abruptly canceled appearances. Rapper Azealia Banks was said to have come down with a throat ailment while Lollapalooza organizers announced that Death Grips, a rap group from California, "chose not to appear."

The festival largely went off without a hitch otherwise, with rains muddying fields early on Friday before sunshine and cooler-than-normal temperatures provided comfortable conditions for the fans.

Ben Gibbard announced that the show would be the last for his group the Postal Service. Local hip-hop artist Chance the Rapper, whose uplifting tales about rising above the gun violence on Chicago's streets, was such a success on a smaller stage that many could not get close enough to see the 20-year-old.

The dance stage Perry's - named after Lollapalooza organizer Perry Farrell - was one of the most popular. Bottom-heavy bass music dubstep dominated that area, with acts such as Baauer - known for his track "Harlem Shake" and the hundreds of social media dance routine videos it spawned.

Grant Kwiecinski, aka GRiZ, played saxophone over his squelching bass tunes. He first attended four years ago as a fan, an event that contributed to him making a career of music.

"My one experience with Lollapalooza was in 2009 - it was actually the first music festival I've ever been to," he said in an interview. "It was one of those very cool memories where it all starts to make sense to you very quickly."

Android Device Manager beginning to push to phones

The settings on a few phones have turned up an entry for the new Android Device Manager — have you checked yours?

It looks like the first stage of the new Android Device Manager is pushing out to a few people, but the service is not yet live. Google told us their new "find my phone" service would be hitting all Android devices running Android 2.2 or higher sometime this month, and while there's nothing to be found on the web side, the device administrator is showing up slowly.

Oddly enough, there doesn't appear to be an associated apk file or a new version of Google Play services attached, and right now nobody is really sure where to find the details. The good news — and this is really good news — is that the reports are coming from everywhere, not just the U.S. look for Android Device Manager to be a world-wide roll out.

You'll surely want to check and see if you're one of the chosen few, so here's how you can do that. Grab your phone, and open the settings. Under the Security section, look for the Device administrators section. Tap it, and see what's there. We're not seeing it yet on any devices in the office, but Reddit is full of folks with the new settings. If you see it, too, be sure to shout out in the comments.

New program available for Twin Bridges students | The Madisonian

Twin Bridges Schools? officials and staff wasted no time in initiating their 21st Century Community Learning Center program after being notified of receiving the grant award in mid-June.

?We had basically a month to get most of the pieces in place,? Superintendent Chad Johnson said. ?These two weeks of the summer program are really about getting our feet wet as we prepare for after-school and a full summer program next year.?

The Twin Bridges CCLC aims to incorporate the family and the community into the educational process of the students, with focus on bridging such relationships while incorporating the Montana Common Core and STEM principals in a hands-on, life-experience, fun and educational manner.

Projects for CCLCs range from character education, drug and violence prevention, expanded library hours, recreational activities, tutoring services, arts and music education, and more. Lunch is provided during the summer and snacks during the after-school program the rest of the year.

About two-dozen children gathered in the home-ec room last Wednesday, the third day of the program in Twin Bridges. The four groups ? incoming kindergarteners, grades 2-3, first graders, and grades 4-6 ? sat patiently while program director Michelle Head and para-educator Shelley Tilstra passed out materials for that morning?s activities. The youngest group practiced writing the alphabet while the others worked on fractions, poems and independent reading.

?It?s project based,? Head said. Students were polled the day before on their favorite flavor of ice cream. The poll results were used to create a graph. Ice cream poems and crafts were also created.

Once the kids caught up on their projects and assignments from earlier in the week, the day was geared toward bike safety, which was evident from the chatter about Barbie bikes, protective pads and popped tires.

More than 16,000 students were served by the state?s 79 CCLCs last year, according to Office of Public Instruction?s Educational Program Representative, Mary Ellen Earnhardt.

?Research shows that kids who do not have these opportunities decline in academic growth,? Earnhardt said. ?It?s a good thing and helps communities. It?s made such an impact on kids.?

Head said she has a lot to learn about the program but is hopeful about its future. She was ready to start right away this summer because the children needed it. Johnson agrees that there is a fairly steep learning curve. He believes Head was the right choice to guide the new program. Head served as one of the grant writers and her knowledge of the program, the application process and the ultimate vision of where it may go were evident from the beginning, according to Johnson. Also involved in the grant writing process were Aaron Griffin, Jamie Reynolds and Mary Beth Walsh.

Johnson said the application process took about 100 hours and included much of the preparation for the program. He had previous knowledge of the grant from his work in a different school district.

?It has always been on our radar, but this was the first year Twin Bridges Schools actually met the qualification standards,? Johnson said. ?Recently, we have been struggling with developing an after-school program that continues to put the focus on academics, community and family. This is just the opportunity.?

State education officials apply for the federal grant and then schools apply for sub-grants from the state. Other local organizations are also able to apply for sub-grants. To be eligible, schools have to have a 40-percent free and reduced lunch rate. Sheridan Elementary and Ennis K-12 were grantees in 2010.

The Highway Loss Data Institute recently reported on the Ford F-250 pickup's popularity among car thieves. But as nice as the F-250 can be, the National Insurance Crime Bureau?knows that some brand-conscious baddies have a taste for high-end marques. And so, it's published a list of the ten luxury rides that car thieves love.

To gather its data, the NICB looked at auto thefts reported over four calendar years: 2009, 2010, 2011, and 2012. According to the organization,?4,384 luxury vehicles were stolen during that period.

To add some nuance to its analysis, the NICB divided cars into three segments: compact luxury, mid-sized luxury, and premium luxury. Between 2009 and 2012, 2,150 compact luxury cars were stolen -- considerably more than the 1,734 mid-sized luxury cars and the 500 premium luxury cars that went missing. (Though the NICB doesn't say so, we'd guess that compacts were most popular with thieves because they're cheaper and thus, more numerous than mid-size and premium models.)

And so, the moment you've all been waiting for -- the 10 most-stolen luxury rides:

?The NICB also released a list of the most popular states for car thieves to ply their trade. Chances are, you can guess the top four without looking, but just so you know:

The NICB found that recovery rates on stolen luxury vehicles was fairly high -- at least compared to mass-market rides. On average,?83.7 percent of the vehicles stolen during the study period were recovered.

That said, some cars fared poorer than others. The?Infiniti G-Series had the highest number of unrecovered vehicles (83 of 405). Two Mercedes-Benz models often went missing for good, too: the E-Class (80 of 381 unrecovered) and the C-Class (78 of 485).?

Curiously, though fewer premium models were stolen than others, premiums were far less likely to be recovered. Among compact and mid-size luxury vehicles, just 14.3 percent and 13. 5 percent remained unrecovered at the end of the study. With premium vehicles, the 34.4 percent remained at-large.

Oil falls after data show tepid US jobs growth

The price of oil fell Friday after two days of big gains, as investors took profits following a report that showed job growth slowed in the U.S. last month.

Benchmark crude for September delivery fell 95 cents to close at $106.94 per barrel on the New York Mercantile Exchange. Oil still finished the week up $2.24 a barrel, or 2 percent, due to a gain of $4.81 over Wednesday and Thursday.

U.S. employers added 162,000 jobs in July, the government said, a modest increase and the fewest since March. Although the unemployment rate dropped to a 4 1/2-year low of 7.4 percent, that was one of few hopeful signs in an otherwise lackluster report.

At the pump, the average price for a gallon of gasoline held steady at $3.63. That's up 15 cents from a month ago and 10 cents higher than at this time last year.

Brent crude, traded on the ICE Futures exchange in London, fell 59 cents to finish at $108.95 per barrel. Brent gained $1.78 a barrel for the week.

In other energy futures trading on the Nymex:

Mayor believes stadium is good investment

RATEPAYERS have paid off more than $600,000 of debt, which was left in the hands of the Mackay Regional Council after it took over operations of the Virgin Australia Stadium.

Mayor Deirdre Comerford said it wasn't "pleasant" to have to tell the community the extent of the $635,000 bill, which includes paying off outstanding power bills, wages and the cost of hosting NRL matches.

But she is confident the $11.3?million stadium is a solid investment for the community.

The public was invited to attend yesterday morning's press conference, and councillors showed a united front, with many of them watching the mayor address the media pack. Council is in the process of developing a business plan to manage the cost of the stadium, she said.

"The key is ... that we will develop a business plan, so we can ensure for our community that we can run this as effectively, and cost effectively as we can," Cr Comerford said.

The current Virgin Australia Stadium manager, Julie Anderson, will finish up in early September, and a senior officer at the MECC will take charge. At the moment there is a $200,000 line in the council budget allocated to fund the running of the stadium.

The Bulldogs versus Knights NRL match, which was played only a month after council was in control of the stadium, ran at an $185,000 loss.

But $450,000 of debts were left to council, when they took over operations.

"There were power bills outstanding for about $70,000 and it was also down to maintenance and cleaning bills, fire alarm maintenance ... top dressing the field," she said.

"So those figures are real bills owed to real businesses in Mackay. And one can say ... council was doing the right thing by many local businesses in our community."

THE stadium won't host another NRL game if councillors know it will run at a loss.

That's the opinion of Mayor Deirdre Comerford.

She said they would have to know if events like that would, at the least, "break even", to get a green light by councillors.

"But it is clear to say, we can still see the value of having an NRL match, for a variety of reasons," she said.

Cr Comerford has been in meetings with NRL officials to discuss the stadium's best bet at hosting an event.

The previous match was a huge learning curve, and things would change if another game of that scale was to be held at the stadium.

"There are better ways to do things for the future," she said.

However, the Virgin Australia Stadium has key events coming up.

Mackay District Rugby League has secured a deal to host their grand final match later this year.

And on September 21 the stadium will be filled with big hats and boots when the Professional Bull Riders (PBR) bring their show to Mackay.

Cr Comerford said, if the opportunity to host another musical spectacular, like March's KISS concert, came about, council would absolutely look into it.

CUTTERS HOPE TO STAY

THE Mackay Cutters have called the Virgin Australia Stadium home for two years, and executive officer Glenn Ottaway hopes it will stay that way.

Mayor Deirdre Comerford said the agreement allowing the Cutters to stay on board at the stadium would be looked at in council's development plan.

"Certainly they are currently tenants at the stadium and they will be part of the business plan going forward, so they will need to pay their way," she said.

Mr Ottaway said increased cost on the Cutters would be a huge burden on the club.

"We are a not-for-profit organisation, everything we earn is from the support of sponsors and the community, but 100% of what we make goes back into the club," he said.

Cr Comerford said the Cutters were unique, in comparison to other clubs, as they didn't have a leagues club with poker machines pooling in money for them.

Mr Ottaway said Cutters and council officials had been meeting regularly, even daily, to discuss operations at the stadium. He said he was promised by council they would ride out the rest of the season, and was confident they could make an agreement with council.

How to Avoid Becoming Part of "No Vacation Nation"

The US is known for being the ?No Vacation Nation." Not only do we get less vacation time that many other countries, we are more likely not to use the vacation time we have. Nearly ? billion vacation days go unused each year in the US.

People who don?t use their vacation time are more likely to develop heart disease and depression, and are even at greater risk of death than those who do. If you don?t have any vacation plans for this summer, it?s not too late to get away. Early fall is actually my favorite time of year to travel. Once the kids are back in school prices, crowds, and temperatures go down. Before you make plans, make sure you take the best kind of vacation for you by first looking at your day-to-day lifestyle.

When Life is Routine

If your life is routine, the days seems to blend into one another, or you find yourself pondering, ?Is this all there is?? you could stand to shake things up. St. Augustine said ?The world is a book and those who do not travel read only one page.? Read another page by traveling somewhere you?ve never been before. Vacationing in the same place year after year might be pleasant (as in boring), but it won?t provide much stimulation. It won?t make you a more interesting or interested person, either.

Meeting new people, eating different foods, finding your way around unfamiliar places, and taking different modes of transportation are all ways that travel is stimulating. If you travel abroad and have to try out a new language, even better! Travel forces you to use skills that remain dormant and boosts your confidence. If you stop pushing yourself to try new things, eventually your world and confidence shrink.

When Life is Hectic

Many people have the opposite problem?their day-to-day life is crazy and stressful. These people imagine they would benefit from a more relaxing vacation. The problem with forced relaxation is that if you?re used to a hectic life, a completely unstructured vacation with days of nothingness stretched out before you will be stressful. There is no point in white-knuckling it on the beach wishing you were checking your email.

A better choice for you might be a guided tour. A tour can provide enough stimulation to hold your interest, but not much stress since all the details and arrangements are left to others. There are tours for all price ranges, age groups, interests, and levels of activity. Guided tours can be as active or cerebral as you like. You can white water raft the Grand Canyon, volunteer to save turtles in Costa Rica, or explore the art of Italy.

If independent travel has always been your style and you really can?t see yourself doing a tour, you might want to dip your toe into the waters by signing up for a few organized day trips. You?ll find you learn more and stress less with a professional tour guide. No worries about driving, directions, or parking?all you have to do is show up. Leaving the driving to others can be a great relationship saver, too. Driving in a foreign country with your partner navigating can lead to some serious friction. (Ask me how I know this!)

When You Absolutely Can?t Get Away

If financial restraints or personal obligations can make going away unrealistic, try a ?staycation." If possible, check into a local B&B, hotel, or resort. If not you can sleep at home. But play tourist for the day?avail yourself of the ?must-do? sites and experiences in your area that you rarely, or never, get around to. Even a 24 hour staycation can leave you greatly refreshed.

No Vacation? Try Meditation

When you find you need to get away right now, but it?s just not possible, give yourself a mini-break anytime you need one with meditation. If you haven?t meditated before, you?ll have more success using a guided meditation or brainwave entrainment MP3 to get started. Then go someplace quiet, get comfortable, and listen, using a headset or ear buds. You should feel emotionally lighter, refreshed, and more relaxed immediately. Do as needed whenever you could use a mini-vacation.

While meditation is one of the most beneficial habits you can incorporate into your daily life, it?s still not a substitute for a getting away. I recommend experiencing the benefits of both by being part of the ?Meditation and Vacation Nation?!

Former California governor and bodybuilder Arnold Schwarzenegger is launching a new line of nutritional supplements in September. His Arnold Series supplements will focus on four areas: performance, power and strength, nutrient support and recovery.

"I?ve been on a crusade to promote fitness for more than four decades," Schwarzenegger said. "That has led to the largest health and fitness convention in the world, six books, seminars all over the globe and visits to all 50 states as chairman of the President?s Council on Physical Fitness."

He?s partnering with Denver-based MusclePharmCorp. Schwarzenegger said that after meeting with the MusclePharm team, learning about the company, and spending time with the founders, he knew they would be the perfect partners.

Using video-based support groups for rural women with breast cancer

rural California2Support groups can help women with breast cancer reduce pain and emotional distress, while providing a source of encouragement, camaraderie and advice. Yet, as I explained yesterday in a?press release, joining support groups?is often impractical for breast cancer patients?who live in remote areas:

?Women in rural areas have a hard time finding other breast-cancer survivors,? said?[Cheryl Koopman, PhD, a professor of psychiatry and behavioral sciences]. Many wish to communicate with one another, but they can face a number of challenges ? such as snowed-in mountain passes, limited public transportation and high travel costs ? simply getting to support groups, which frequently are located in major cities. Moreover, patients are often too fatigued from cancer treatments to make the trip.

This is what prompted the Sierra-Stanford Partnership, a collaboration between rural-community advocates Joanne Hild and Mary Anne Kreshka, of the Sierra Streams Institute, and Stanford?s Koopman. The collaborators are now seeking breast-cancer patients living in one of 27 northern California counties to participate in a study of the effectiveness of support groups conducted via video chat.

This form of support group is different from Internet support groups, because it?s more personal, Koopman told me:

Text-based, Internet support groups are already available, but many patients want a more interactive form of communication. ?A lot of women tell us they would like to see the support-group leader and one another,? Koopman said. The strength of the video-based support group is that breast-cancer patients can see and interact with one another with minimal cost and effort, she said.

The ultimate goal is?to help researchers design the best kind of support group for breast-cancer patients who live in rural areas. Information for volunteers interested in participating in the study can be found here.

Rising costs, Nigeria thefts blot Shell profits

LONDON (Reuters) - Rising costs and a surge in oil thefts in Nigeria, among other factors, hit Royal Dutch Shell's second quarter profits, a result that outgoing chief executive Peter Voser called "disappointing".

Shell said it took a $700 million hit for Nigeria thefts - which it said cost Nigeria itself $12 billion a year - and for the tax impact of a weakening Australian dollar. Shell recently put more of its Niger Delta activities up for sale.

Adjusted second quarter net earnings on a current cost of supply (CCS) basis came in at $4.6 billion, down from $5.7 billion a year ago and below analysts' expectations of around last year's figures. Shell shares company dipped 4.4 percent.

"Higher costs, exploration charges, adverse currency exchange rate effects and challenges in Nigeria have hit our bottom line," said Voser, who is due to step down at the end of this year. "These results were undermined by a number of factors - but they were clearly disappointing for Shell."

SHALE CHARGE

Including adjustments, Shell's CCS result was lower still at $2.4 billion, mainly due to a $2.2 billion charge for liquids-rich shale properties in North America "reflecting the latest insights from exploration and appraisal drilling results and production information".

Shell, Europe's top oil company, vies with U.S.-based Chevron for the world No. 2 spot among listed oil companies behind Exxon Mobil. Exxon is due to report results later on Thursday.

Shell's results came in the same week as disappointing results from rival BP and on the same day as smaller Italian group was forced to cut its output target - partly because of Nigerian troubles.

Electronic Arts' college sports franchises have been sacked by a U.S. federal appeals court.

In a 2-1 vote, the 9th U.S. Circuit Court of Appeals agreed with a lower court that EA had used the images in its video games of several ex-NCAA athletes without their permission in its NCAA football and basketball series. The decision comes two weeks after EA lost the rights to put the NCAA logo and name on its games beyond this year.

Circuit Judge Jay Bybee, writing for the majority of the court, said EA's game "literally recreates [Arizona State University quarterback Samuel] Keller in the very setting in which he has achieved renown."

Circuit Judge Sidney Thomas dissented, however, arguing that the games' creative elements "predominate over the commercial use of the athletes' likenesses" and that "Keller's impressive physical likeness can be morphed by the gamer into an overweight and slow virtual athlete, with anemic passing ability".

The decision could open up additional legal action against the video game publisher from other former college athletes who have been unhappy with their likenesses being used in the games without compensation.

In a statement, EA said it was "disappointed with the ruling against First Amendment protection in the Keller case. We believe the reasoning in Judge Thomas' dissent in that decision will ultimately prevail as we seek further court review."

EA is already facing similar suits to the one ruled on today by the appeals court. The company asked a judge on Tuesday to dismiss the latest complaint, which was filed on behalf of a group of athletes led by Ed O'Bannon, a former star at the University of California, Los Angeles. Also, in May, a federal appeals court revived a similar suit from former Rutgers University quarterback Ryan Hart.

EA had argued in the case that using the athletes' likeness was protected under the free expression clause of the First Amendment. Judges disagreed in the case of college athletes, but?in a separate decision?agreed with EA in the case of former pro players.

The court unanimously upheld the dismissal of a suit by Hall of Famer Jim Brown, whose image was used in EA's Madden game.

EA has used the First Amendment argument before when facing legal action for images in its games. In 2011, Bell Helicopter parent Textron sued over the game maker's use of images of a trio of real world helicopters in "Battlefield 3."

Textron argued its choppers were used without permission and EA failed to pay licensing fees. EA claimed protection under the First Amendment and the use of the aircraft constituted fair use.

The case is still pending, though EA did lose an attempt to have the complaint dismissed a year ago.

While the Madden franchise is a larger driver of revenues, EA still relied heavily on its NCAA franchise. But sales this year have been soft, say analysts. John Taylor of Arcadia Investment Corp. said he believes sales of the 2013 installment are off roughly 10 percent compared to the 2012 game.

And starting next year, the company won't be able to use the NCAA name. The league recently announced it would not negotiate a new contract with EA when the current one expires next June.

"We are confident in our legal position regarding the use of our trademarks in video games," the NCAA said at the time. "But given the current business climate and costs of litigation, we determined participating in this game is not in the best interests of the NCAA. ... The NCAA has never licensed the use of current student-athlete names, images or likenesses to EA. The NCAA has no involvement in licenses between EA and former student-athletes."

EA has vowed to continue making college sports games, however.

"Our relationship with the Collegiate Licensing Company [which manages the trademarks of the majority of the colleges in the game] is strong and we are already working on a new game for next generation consoles which will launch next year and feature the college teams, leagues, and all the innovation fans expect from EA Sports," said Andrew Wilson, executive vice president of EA in a statement.

Analysts say they don't expect the loss to have a material financial impact on Electronic Arts, noting that the NCAA was a co-defendant in the suit.

"The transgressor here is the NCAA, I believe," said Michael Pachter of Wedbush Securities. "I don't believe EA said to the NCAA 'can we use licensed images of the players.' The NCAA said 'no' and EA said 'we're going to do it anyway'."

"The NCAA has the right to license the athletes image without compensation to the athlete if he's playing in a [real world] game," Pachter added. "The question is: Can it exploit the likenesses out of the game? That depends on the contract the player signs with the NCAA."

JP Morgan Ventures Energy Corporation, a unit of the giant New York banking company JP Morgan Chase & Co., has agreed to pay a fine and refund ?unjust? profits totaling $410 million, the federal government says.

That, says the Federal Energy Regulatory Commission, will settle its complaint that the Morgan unit manipulated the California and Michigan electric markets from September 2010 through November 2012.

FERC investigators determined that JP Morgan Ventures Energy Corporation engaged in 12 manipulative bidding strategies designed to make profits from older power plants that were usually out of the money in the marketplace because they were inefficient.

FERC investigators further determined that JPMVEC knew that the California Independent System Operator and the Midcontinent Independent System Operator received no benefit from making inflated payments to the company, thereby defrauding the ISOs by obtaining payments for benefits that the company did not deliver beyond the routine provision of energy.

FERC investigators also determined that JPMVEC?s bids displaced other generation and altered day ahead and real-time prices from the prices that would have resulted had the company not submitted the bids.

Under the agreement, JPMVEC will pay a civil penalty of $285 million to the U.S. Treasury and disgorge $125 million in unjust profits. The first $124 million of the disgorged profits will go to ratepayers in the California Independent System Operator, which operates the California electricity market. The other $1 million will go to ratepayers in the Midcontinent Independent System Operator.

JP Morgan Ventures Energy Corporation admits the facts set forth in the agreement, but neither admits nor denies the violations, says FERC. The company did, however, agree to waive claims for additional payments from the California ISO relating to two of the strategies under investigation.

JP Morgan Ventures Energy Corporation also will conduct a comprehensive assessment by outside counsel of its policies and practices in the power business.

The case stems from multiple referrals to FERC from the California ISO and MISO market monitors in 2011 and 2012 regarding JP Morgan Ventures Energy Corporation?s bidding practices. These practices were the subject of four emergency tariff filings by the California ISO and MISO, each of which was approved by the Commission.
