Leaked docs give new insight into NSA's searches

LONDON (AP) ? Documents published by the Guardian newspaper are providing new insight into the National Security Agency's surveillance of world data, giving an over-the-shoulder look at the programs and techniques U.S. intelligence analysts use to exploit the hundreds of billions of records they gather each year.

Dozens of training slides published Wednesday divulge details about XKeyscore, one of a family of NSA programs that leaker Edward Snowden says has given America the ability to spy on "the vast majority of human communications."

Some of the slides appear to carry screenshots showing what analysts would see as they trawled the intercepted conversations, including sample search queries such as "Show me all encrypted word documents from Iran" or "Show me all the word documents that reference Osama Bin Laden."

In an indication of the program's scope, one slide says that XKeyscore has led to the capture of more than 300 terrorists. In a statement, the NSA said that figure only included captures up to the year 2008, and pushed back against any suggestion of illegal or arbitrary collection of data.

"These types of programs allow us to collect the information that enables us to perform our missions successfully ? to defend the nation and to protect U.S. and allied troops abroad," the statement said.

How and from where the program draws its data isn't completely clear, but one slide said XKeyscore was supported by 700 servers and 150 sites across the globe. Another slide seemed to show the program drawing data from a body codenamed SSO ? an apparent reference to the NSA's Special Source Operations, which previous Guardian articles have described as capturing large numbers of communications between the United States and other countries.

The volume of data available to analysts through XKeyscore appears to be vast. The Guardian quoted one slide as saying that nearly 42 billion records had been captured by the system during a one-month period in 2012 ? a rate of half a trillion records every year. So much content was being collected, the newspaper said, that it could only be stored for short periods of time ? generally just a few days.

"At some sites, the amount of data we receive per day (20+ terabytes) can only be stored for as little as 24 hours," the Guardian quoted one document as saying.

In a message forwarded to The Associated Press by Guardian spokesman Gennady Kolker, journalist Glenn Greenwald said the article about XKeyscore drew on half a dozen documents supplied to him by Snowden in Hong Kong. One of them ? a 32-page overview of the program ? was published in its entirety, albeit with several pages redacted.

The documents are the first to have been published in the Guardian since Snowden, who remains stuck at a Moscow airport, applied for temporary asylum in Russia on July 16.

Russian President Vladimir Putin said he'd be inclined to accept on condition that Snowden agreed not to hurt U.S. interests ? implying that the American would have to stop leaking secrets. But Snowden's Russian lawyer, Anatoly Kucherena, said Wednesday that the material for the article was provided long before Snowden promised to stop leaking.

"He warned me that he had already sent to the press an array of revealing information and secret documents and, unfortunately, could not stop its publication," Kucherena was quoted as saying by the Interfax news agency.

Israel and Palestine aim to agree peace deal within nine months

Israel and Palestine will seek to reach a peace agreement within nine months and negotiators will meet again within two weeks after holding a ?positive? first round of talks, US secretary of state John Kerry said today.

Senior aides to Israeli prime minister Benjamin Netanyahu and Palestinian president Mahmoud Abbas held their first talks this week since 2010, but focused largely on the framework for negotiations rather than the substance of their dispute.

Speaking after the meetings, which included a session with president Barack Obama and vice president Joe Biden as well as direct talks between the two sides without US officials present, Mr Kerry said he believed peace was possible despite the obstacles.

The United States is seeking to broker an agreement on a ?two-state solution,? in which Israel would exist peacefully alongside a new Palestinian state created in the West Bank and the Gaza Strip, lands occupied by the Israelis since a 1967 war.

The major issues to be resolved in the talks include borders, the future of Jewish settlements in the West Bank, the fate of Palestinian refugees and the status of Jerusalem.

    President Energy sees good flow rate potential from old Argentinian wells

    () has revealed that old shut-in wells in Argentina are showing good potential for commercial rates after a programme of hydraulic stimulation.

    The AIM-listed company has a 50% stake in wells PE-7 and PE-8 at the Pozo Escondido field in the Puesto Guardian concession.

    PE-7 is in the process of being cleaned up, having been shut in for 27 years, and is demonstrating good flow rate potential as expected. It is swabbing at gross flow rate of liquids (oil and injection water) of 230 barrels of oil per day.

    The oil cut is currently 30-40%, President added, and continues to rise steadily as the injection water is cleaned up.

    After finishing the clean-up, the plan is a re-perforation of the deeper A6 sands with the well to be produced from both sections.

    PE-8 is also showing potential for commercial rates, having just started the clean-up phase.

    ?The preliminary performance of the two Pozo Escondido stimulations is providing strong encouragement for the potential for reserves in the carbonate reservoir, and for considering further stimulation across the large portfolio of old wells in the concession,? the company said in a stock exchange statement.

    Well DP 1001 meanwhile is now producing 85% oil after its stimulation.

    Borst will retire as Toyota finance chief - Automotive News

    George Borst's move in 1997 to Toyota Motor Credit Corp. puzzled some Toyota insiders because of his lack of experience within the finance arm.

    LOS ANGELES ? George Borst, who led Lexus through the endaka currency exchange crisis of the mid-1990s and who has been CEO of Toyota Financial Services for the past 13 years, announced his retirement from Toyota today.

    Borst will stay with the U.S. credit and insurance arm through the end of September, he told a meeting of top Toyota and Lexus dealers. He will turn 65 on Sept. 2.

    His replacement will be Mike Groff, 58, the seventh employee hired by Toyota Motor Credit Corp. when the captive finance company was formed in 1983. Groff has been head of Toyota Financial Services' sales and marketing for the past five years.

    Borst presided over massive growth in Toyota's finance arm ? from about $21 billion in assets in 1997 to $91 billion today, with its operating income jumping sixfold in that period, to $1.8 billion. Toyota's share of its dealers' finance business has soared from 37 percent in 1997 to 64 percent today.

    In an interview, Borst said Groff is an excellent choice as his successor.

    "Mike has worked in the branches and regions, in operations and strategic planning," Borst said. "His five years in sales and marketing have been the toughest five years ever, and we've had terrific results in that time."

    Hired by McCurry

    Borst was hired in 1985 by legendary Toyota Motor Sales U.S.A. executive Bob McCurry to oversee the marketing department, a position that evolved into running Toyota's budding strategic planning department in 1991.

    But his biggest challenge may have been as general manager of Lexus Division, a job he assumed in 1993. During his tenure, the dollar collapsed against the yen, making the cost of Japan-built vehicles sold in America much more expensive. The yen went from 115 to 80 to the dollar by 1995, and Lexus' launch momentum was derailed.

    "I am most proud of my time at Lexus," Borst said in an interview. "When we started to struggle, we could have had bargain-basement sales and eliminated all those customer handling touches. This was our first test of who we were. And in 1995, even as our sales volume had dropped, we still swept the J.D. Power awards."

    Borst's move in 1997 to Toyota Motor Credit Corp. puzzled some Toyota insiders because of his lack of experience within the finance arm. At the time, even Borst admitted he was a bit at sea. But his background in strategic planning helped meld an organization that has become a financial powerhouse.

    In 2000, Toyota Motor Corp.'s 16 separate finance arms worldwide were absorbed by a new global finance unit called Toyota Financial Services Corp. Borst was named CEO of Toyota Financial Services U.S.A.

    One of his first moves was to create a collaborative management committee to analyze strategies to help build the business. He also changed the unit's field structure.

    In 2001, Toyota decided that its 36 finance branch offices should handle only dealer business and stop handling customer interaction. Instead, three call centers handled all customer service. About 1,000 people were affected, and some branch offices were closed. But with more than a year's notice, Toyota Financial suffered little loss of service in the move.

    Award winner

    The increased efficiencies allowed the unit's volumes to nearly double in five years ? growth that slowed only when the recession hit. Again, Borst made a tough decision, refusing to let Toyota Financial back out of leasing when the rest of the industry panicked. Toyota stood by its residual values, and dealers and retail customers stayed loyal to the brand.

    As a result, Toyota has 345,000 off-lease customers returning to the fold within the next 18 months ? a significant opportunity for loyalty retention, Borst said.

    "When you think of how competitive this market is, that's a significant advantage," he said. "Were giving dealers 18,000 leads a month from this."

    Toyota Financial Services is now the No. 2 issuer of commercial paper in the world, behind General Electric. And the unit's in-house treasury department has won all four of the financial services industry's coveted awards for performance, stability, speed-to-market and risk management. No company, automotive or otherwise, has ever done that, Toyota said.

    Those were key reasons why Borst was named an Automotive News All-Star in 2012.

    Borst said he was proud that Toyota's finance arm ranked atop seven categories in the recent National Automobile Dealers Association survey.

    "Toyota dealers can only get their cars from Toyota," he said. "But finance is a commodity product. It's a relationship business."

    Experts predict long antitrust road for Omnicom, Publicis

    WASHINGTON/BRUSSELS (Reuters) - Publicis and Omnicom will most likely have to shed some assets in order for their mega deal to win approval from regulators in the United States, Europe and 40 other countries where they operate.

    The deal would combine the world No. 2 agency, Omnicom, with the No. 3, Publicis, to create the world's largest agency. The companies have expressed confidence that the transaction will move forward.

    Four antitrust enforcers polled by Reuters said they thought the deal would be approved, but require some asset sales to restore competition, while three others were more cautious over the regulatory outcome given the complexity of the deal.

    Publicis Chief Maurice Levy defended the merger as necessary in a changing, increasingly electronic landscape.

    "This is a new company for a new world," Levy said. "It will be able to face the exponential development of new Internet giants like Facebook and Google, changing consumer behavior, the explosion of big data, as well as handle the blurring of roles of all the players in the market."

    There are other large advertising firms. The current leader is WPP , and there are three other major firms in the industry - U.S.-based Interpublic , France's Havas and Japan's Dentsu , as well as many smaller operations.

    In Brussels, antitrust experts said the deal would be difficult for enforcers to review.

    "The companies claim to have complementarities, both geographically and in terms of activities. This might well be true but there will be significant overlaps in many relevant markets," said Brussels-based antitrust lawyer Salom? Cisnal de Ugarte of Mayer Brown.

    "It remains to be seen how big the combined market shares are and whether the European Commission can remedy potential competition concerns by requesting divestments or behavioral commitments," she said.

    Brussels-based Jacquelyn MacLennan of White & Case LLP was one of several antitrust experts who predicted one or more segments of the companies could be sold off.

    "This could be a tricky transaction for regulators. The companies have so many wide-ranging activities. Every time there is a mega-merger there are likely to be competition issues and the Commission will be more cautious," said MacLennan.

    Competition issues could focus on whether the companies are competing head to head in relevant national markets. "If there are problems the parties may propose sell offs - such as certain local agencies for example," MacLennan said.

    The new company - Publicis Omnicom - will be traded in New York and Paris. The company, which would have combined sales of nearly $23 billion and some 130,000 employees, brings together Publicis brands such as Saatchi & Saatchi and Leo Burnett with Omnicom's BBDO Worldwide and DDB Worldwide.

    Experts said the main competition issue is likely to be in media buying, which is where agencies purchase advertisements in various formats - such as television or print - on behalf of customers.

    Pivotal Research analyst Brian Wieser estimated that Publicis Omnicom would account for almost 20 percent of global media spending and closer to 40 percent in the United States.

    To allay such concerns, the companies might have to sell small brands in some countries, said a person close to the talks.

    A U.S.-based antitrust expert predicted the deal would win Washington's approval since it would leave large firms with a smaller U.S. presence - Havas and Dentsu - that could expand.

    "The antitrust issues are being exaggerated and (the deal)faces minimal risk," said the expert, who asked to speak privately for business reasons. "It's not like AT&T and T-Mobile," he said, referring to the failed 2011 attempt to merge the two telecom companies.

    But he added winning antitrust approval from dozens of countries would be time-consuming, and that China was likely to be the last to finish the process.

    Evan Stewart, an antitrust expert with New York's Zuckerman Spaeder LLP, said that if the merger went forward and clients were hurt, new agencies would rise up to compete.

    "Somebody can set up a competing agency with six guys and gals in a garage. You don't need steel mills and iron ore boats. You don't need any of that stuff," he said. "I don't see any antitrust issues; I don't see consumers being hurt here."

    But Bert Foer, head of Washington, D.C.-based American Antitrust Institute, said the vast combined company would have too many fingers in too many strategic business pies. Asked about regulatory approval, he said: "I don't think they should get it."

    Japan diplomat visits China amid strained ties

    Japan's vice foreign minister today set off for a two-day visit to China, Tokyo said, the latest chapter in a bid by Prime Minister Shinzo Abe (pic) to hold high-level talks with Beijing.

    The trip comes as territorial tensions and maritime skirmishes have all but frozen relations between the Asian giants.

    Akitaka Saiki, the top bureaucrat in Japan's foreign ministry, was expected to meet with his Chinese counterpart Zhang Yesui and other senior Chinese officials, Jiji Press news agency and other Japanese media reported today.

    "We coordinated the trip as Mr Saiki has hoped to visit China as soon as possible since he assumed his post" last month, a foreign ministry official told AFP.

    On Saturday, Abe told reporters in Manila that he hoped to hold top-level talks with China.

    One of his closest advisers also said at the weekend that the testy neighbours could soon hold a meeting.

    "I think a summit will be held in the not-so-distant future," Isao Iijima was quoted by Japan's Kyodo news agency as saying.

    The diplomatic overtures come on the back of a long-running dispute between Tokyo and Beijing over ownership of an East China Sea island chain.

    Since the row flare anew last year, China has become increasingly active in the seas around the disputed archipelago, while it has cancelled diplomatic and cultural events involving Japan.

    On Friday, the Chinese coastguard entered disputed waters surrounding the islets for the first time, straining an already tense situation as Tokyo mulled plans to establish a US Marines-style force to protect its claim on the islands.

    Although Chinese government ships have been in and out of the waters for many months, this was the first time they have ventured there since Beijing combined several agencies under the coastguard flag last week. - AFP, July 29, 2013.

    TOKYO (AP) ? Camera and medical equipment maker Olympus is facing another legal battle over its treatment of a whistleblower employee a year after Japan's Supreme Court ruled it should reinstate the man in his regular job.

    Masaharu Hamada has been assigned by Olympus to quality training, in which he has no experience. He sees the assignment as harassment.

    He wants the Tokyo District Court to order Olympus to abide by the top court's ruling. Olympus says it complied with the Supreme Court decision.

    Hamada was joined Monday by Yoshihisa Ishikawa who is suing Olympus for sending him to work under Hamada.

    Hamada first sued Olympus in 2008 after being ostracized for relaying a supplier's complaint.

    He is considered a whistleblower in Japan because he raised questions and was subjected to humiliating punishment.
