Ohio school shooting: State likely to seek adult trial for teen suspect
Suspect T.J. Lane appeared in juvenile court Tuesday, where the judge ordered him held in custody pending trial for Monday's school shooting in Chardon, Ohio. The state is one that routinely transfers minors to adult court.
T.J. Lane, the teenager held as a suspect in a fatal shooting outside a Cleveland-area high school on Monday, appeared in juvenile court Tuesday, where a judge determined that he will remain in custody pending trial. Whether the 17-year-old will face trial as a juvenile or an adult will be determined next month, but Ohio is a state where minors charged with serious crimes are routinely transferred to adult court.

"This is not about bullying," he said, refuting some news reports that the suspect may have been a victim of bullying in the past. "This is about someone who is not well."?He said the likely charges will be three counts of aggravated murder, plus others, and that he expected to ask the juvenile court to allow T.J. be tried as an adult. In addition to carrying a .22-caliber pistol, T.J. also carried a knife into the school, the prosecution says.
All matters related to the legal proceedings would change if indeed T.J. Lane is tried as an adult. The most serious is sentencing: Juveniles in Ohio who commit serious crimes might serve sentences as short as five years; if tried as an adult, T.J. would probably face a maximum sentence of life in prison.
?There?s a big difference. He will be tried like any other adult defendant and sentenced like any other adult defendant,? says Douglas Abrams, a law professor at the University of Missouri School of Law.
The confidentiality that surrounds cases of juvenile defendants would also fall away, allowing media access to the trial and the public release of his name by authorities. Also, unlike in juvenile trials, a jury would decide the case, not a judge.
In 2010, Ohio transferred 303 juveniles, ages 14 to 20, to adult court, according to data from the Ohio Department of Youth Services. One hundred and fifty juveniles aged 17, the same age as T.J., represented half of those. The previous year, the state tried 310 juveniles as adults. Ohio is one of 15 states to mandate that juveniles charged with certain crimes, such as homicide, be tried as adults, says the American Civil Liberties Union, which gives the state a 'C-' rating as a result. The other 35 states leave such decisions to the judge's discretion. It is not yet determined if the charges expected to be filed against T.J. fall under that mandate.
On Wednesday, the juvenile court judge,?Timothy Grendell,?will consider requests from the media to make public any juvenile court records for T.J. and for one of the shooting victims. Juvenile court records are confidential and usually are not made public.

Irsay followed that up with more legible message.? ?We will always communicate with Colt Fans about important issues through all 21st century means to be informative and insightful,? Irsay said.
That?s fine.? But Irsay shouldn?t expect his players to not do the same thing.? Surely, Peyton regarded the issues he raised last month with Bob Kravitz of the Indianapolis Star to be ?important? and ?informative? and ?insightful.?
Anyone who gets it knows that both Irsay and Manning hope to avoid blame for the coming divorce.? They?re playing a game.? In his latest effort, Irsay didn?t play it very well.

The early word on the 84th annual Academy Awards was that silent movie "The Artist" was going to run the board. Then there were five early wins by Martin Scorsese's "Hugo" in technical awards, and it seemed as if it would be a night of upsets.
But, like an old movie serial that keeps you on the edge of your seat until the very end, the throwback to another era in film came on strong and swept three of the four biggies: Best Picture, Best Actor and Best Director.
The wins capped a night of celebrating the history of cinema, with the final act providing a perfect topper, as "The Artist" became only the second silent movie in Oscar history to snag the night's top prize and the first black-and-white one to win Best Picture since "Schindler's List" in 1994. Joining it in the winner's circle with five wins was another loving tribute to the wonder of film, Scorsese's "Hugo."
After the crash-and-burn that was last year's younger-demo-seeking combo of James Franco and Anne Hathaway, nine-time emcee Billy Crystal provided some of that same kind of warm-and-fuzzy feeling to his hosting duties as well. After the tumult that resulted in Eddie Murphy dropping out of the gig in November, the veteran comedian did exactly what everyone wanted him to: he sang, he danced, he made bar mitzvah and Hitler jokes, he spoofed the year's biggest movies and took a lifetime's worth of shots at Kodak.
Michel Hazanavicius bested Scorsese for Best Director for his work on "The Artist." Though he claimed to have forgotten his speech, Hazanavicius proclaimed himself the "happiest director in the world" for taking home such a prestigious honor for his anachronistic feature about the culture clash between the old and new when talkies supplanted silent films in the late 1920s.
In addition to shouting out the film's famous pooch, Uggie, Hazanavicius gave props to the movie itself, saying, "Since this movie has been made, its life is full of grace and it brings to us joy and happiness. Sometimes life is wonderful, and today is one of these days."
He was joined a short time later by his leading man, Jean Dujardin, who beat out the likes of three-time Best Actor nominee George Clooney, his bromantic pal Brad Pitt and fellow first-time nominees Gary Oldman and Demian Bichir for Best Actor. For a guy who spent an entire movie not talking, Dujardin had a simple message for his legion of new American fans: "I love your country!"
The most nominated actor in Oscar history waited an interminable 30 years between awards, but the 17th time was the charm for Meryl Streep, who snagged her third golden man for disappearing into the role of former British prime minister Margaret Thatcher in "The Iron Lady." The always entertaining actress moaned, "Oh my God, oh come on!" at the standing ovation, saying she feared that when her name was read, half of America groaned, "Oh no! Her! Again!"
The night's first Oscar, for Cinematography, suggested that perhaps "The Artist" would not run the board, as it went to Scorsese's "Hugo." As did the second, for Art Direction, which went to the husband-and-wife team that made "Hugo" such a rich visual feast for the eyes. Along the way, the movie also picked up the Oscars for Sound Editing, Sound Mixing and Visual Effects.
Best Supporting Actress went to first-time nominee Octavia Spencer for her role in "The Help," which garnered a standing ovation from the crowd as she struggled to overcome tears in accepting the award for her work as headstrong maid Minny Jackson.
The big night for "The Artist" began with a win for Original Score for untrained composer Ludovic Bource, but it was the cymbal-crashing entrance by Will Ferrell and Zach Galifianakis that helped make the two-song race in the Best Original Song category a memorable one. "Flight of the Concords" star Bret McKenzie won the marathon for "Man or Muppet," noting that it was his lifelong dream to meet Kermit the Frog and, like many leading men in Hollywood, he noted that the fuzzy Muppet is "a lot shorter in real life."
After seven decades in the business, a lithe Christopher Plummer became the oldest actor to ever win an Oscar when he accepted the Supporting Actor statue for his work as a father who comes out to his son after the death of his wife in "Beginners." Holding up the golden statue, Plummer said, "You're only two years older than me — where have you been all my life?" joking that he emerged from the womb practicing his thank-you speech.
Though it wasn't in the running for the biggies, "The Girl With the Dragon Tattoo" didn't go home empty-handed, as it snagged the Best Editing prize for the same duo who took it home last year for "The Social Network." The award for Animated Feature went to director Gore Verbinski, who took home his first Oscar for "Rango."
Director Alexander Payne took home his second Oscar for Best Adapted Screenplay for his collaboration on the script to "The Descendants," while a typically absent Woody Allen will get his Original Screenplay statue in the mail for "Midnight in Paris."

Until now, only charities that have raised $500,000 in total donations for one year were eligible to start mobile-giving campaigns under Mobile Giving Foundation?s rules. For-profit companies that perform the same task are not participating in the new effort.
The expansion of mobile giving depends in large part on the goodwill of mobile carriers like AT&T Mobility, Sprint, and Verizon Wireless. Right now, neither the charity nor the donor pays anything to the carrier to process donations handled through the Mobile Giving Foundation, so the organization wanted to find a way to reassure the carriers.
Under the new rules, small organizations can seek text gifts, but first they?ll have to pass 20 standards of accountability, as opposed to just 11 that were in place for groups that raise $500,000 or more a year. ScienceDaily (Feb. 20, 2012) ? University of British Columbia researchers have identified conservation "hot spots" around the world where the temptation to profit from overfishing outweighs the appetite for conservation.
Combining economic outlook and fisheries population growth rates for all countries currently reported to fish in the ocean, UBC fisheries researchers William Cheung and Rashid Sumaila developed a conservation risk index to reveal the economic-conservation trade-offs of fishing.
Areas with the highest risk index -- those most biologically and economically vulnerable to overfishing -- include the northeastern coast of Canada, the Pacific coast of Mexico, the Peruvian coast, the south Pacific (offshore of New Zealand in particular), the southern and southeastern coast of Africa, and the Antarctic region.
"This index is a guide for determining the appropriate conservation and fisheries management policy for each region," says Cheung, an assistant professor in UBC's Fisheries Centre, who presented his research at the Annual Meeting of the American Association for the Advancement of Science (AAAS) in Vancouver, Canada.
"The most vulnerable areas may need to be protected with special management approaches -- such as marine protected areas, while others may benefit from economic incentive instruments to better manage the ecosystems -- such as territorial use rights in fisheries, or TURFs," says Sumaila, professor and director of the UBC Fisheries Centre.
The index can also help conservation managers use scarce resources in a targeted, efficient and effective way to ensure the conservation of sustainable use of seafood and marine ecosystems, Sumaila adds.
"Fishing has a major impact on marine biodiversity, causing the depletion of many species," says Cheung, who grew up in Hong Kong and focused his earlier research on fisheries in the South China Sea -- one of the most over-exploited areas in the world's oceans. "I witnessed how overfishing can damage marine ecosystems and the goods and services they provide -- but in order to solve the problem, we need an understanding of both biology and economics. Biology determines whether a stock is more vulnerable to fishing, while economics determines how strong the incentive is to overfish the stock now."
The conservation risk index is based on the discount rates of fishers and the intrinsic population growth rates of the fish being targeted. The discount rate is a measure of how much a dollar of fish to be received in the future is worth today -- similar to the long-term lending interest rate of central banks. The intrinsic population growth rate is the difference between the birth and death rate of a fish stock.
Cheung and Sumaila used published discount rates data for all countries that are reported to fish in the ocean, and intrinsic growth rate data for major exploited fish species to calculate the conservation risk index for each half degree square area of the world's oceans (2,500 square-kilometres, roughly the size of Metro Vancouver or three times the size of New York City). The higher the conservation risk index, the more vulnerable the area is.
