My 80 year old parents in law have been renting a 3-level townhome apartment for the last 6 years with no issues, no late payments, etc. At this age and with my mother in law?s dementia progressing it was physically more and more difficult for them to live in such a place. We decided that they needed to move out urgently when my mother in law was sleep-walking and fell from the stairs. They informed their management office about that on March 7 (including a letter from their physician) and asked for a medical waiver to move out before the end of the lease (which is in August). The lady in the management office indicated that she would seek the waiver approval with her manager. When they came to her office on March 23 to confirm their move out date she said that there was a long waiting list for this apartment (it is MPDU and in high demand) so there would be no problem to re-rent it immediately. My in-laws know one couple on the waiting list and these people are interested and able to move without any delays. Therefore, my in-laws were sure that they would not have to pay any penalties for any lease break. They were stunned to find an envelope on their door stating that they owe 2-months worth of rent in penalties because of the early lease termination. They checked with the couple on the waiting list and found that these people contacted the office and were told that the list was long and they could not get this apartment due to the long list. It is not clear why my in-laws have to pay any penalties if the apartment can be re-rented without any delay and the management office is not willing to do it. What rights do they have and what should they do? They have no money and were paying with the help of the housing choice voucher (which is now transferred to a new apartment).
